Interestingly, most often, patients find their way to peer review upon recommendation by their lawyers. Ethical lawyers will not undertake an expensive, time-consuming malpractice case when the issue could be resolved quickly, effi- ciently, and fairly through the den- tal society. Alternatively, patients are referred to peer review via sub- sequent treating dentists when patients present with complaints about their previous dentists; sometimes, the patient’s friends or the dentist who is the subject of the complaint will recommend resolu- tion through peer review. How was the Dr. A and Mrs. P Dispute Resolved? The Peer Review Committee con- ducted a hearing to resolve the dispute between general practitio- ner Dr. A and patient Mrs. P, in accordance with the signed Agree- ment to Submit to Peer Review. Both parties and the Committee concurred on the agreed upon fees for the treatment under review. The Committee was comprised of three general practitioners. All records associated with the treat- ment under review were available to the Committee for their review. Each member of the Peer Review Committee individually con- ducted an assessment of the treat- ment in question. The Committee made a deter- mination based upon the testi- mony, physical and documentary evidence available and a clinical examination conducted at the hearing. Although the Committee deemed the treatment appropriate and agreed that, radiographically and clinically, the care looked proper, they nevertheless ruled against the dentist, because: 1.The dentist should not have inserted the crown with a final cement until the residual pains were resolved. 2.When the residual pains failed to resolve, the dentist should have sought a consultation with an endodontic specialist. Consequently, the dentist’s fees were returned to the patient.
